My Showroom Terms of Service • No-Refund Policy • Privacy Policy
Effective January 2026 — These Terms govern your access to and use of My Showroom and all related listings, advertising, and communications (“Services”). By submitting or purchasing any listing, you (“Client”) agree to be legally bound by the following provisions.
1. Definitions
- Client — any individual or business purchasing or maintaining a My Showroom advertisement or listing.
- Provider — MyShowroom.com.au and its owners, officers, agents, and affiliates.
- Listing — any logo, text, image, or advertisement submitted by the Client for publication on My Showroom.
- Platform — the My Showroom website and all connected systems and infrastructure.
2. Legal Effect
These Terms form a binding contract between the Client and the Provider. Accessing or using any My Showroom service confirms full understanding and acceptance. All rights not expressly granted remain reserved by the Provider.
3. Scope of Service
My Showroom provides a digital shopping showroom and display advertising platform. The Provider makes no guarantees regarding sales, traffic, inquiries, conversions, or ranking; outcomes depend on external market factors beyond the Provider’s control.
3.1 Advertising, Promotion & Platform Discretion
My Showroom may, at its discretion, allocate a portion of aggregated platform advertising revenue toward marketing, promotional, or brand awareness activities intended to support the visibility and growth of the My Showroom platform and its featured shops and services.
Such activities may include, but are not limited to, radio advertising, television advertising, event or brand sponsorships, media placements, and public relations initiatives. All decisions relating to allocation amounts, timing, channels, and execution are determined solely by the Provider based on commercial, strategic, and operational considerations.
Any references on the website, sales materials, or communications to indicative reinvestment strategies, example percentages, or partner thresholds are provided for general informational purposes only and do not constitute a guarantee, entitlement, obligation, or representation of individual benefit to any Client.
The Provider does not guarantee traffic volumes, exposure levels, advertising outcomes, or return on investment for any Client.
4. Ownership & Intellectual Property
All designs, source code, architecture, graphics, and trademarks remain the exclusive property of My Showroom. The Client is granted a limited, non-exclusive license to display submitted materials within their purchased listing only. Copying, scraping, framing, or reverse-engineering My Showroom content constitutes infringement and may result in immediate legal action.
5. Payment & No-Refund Policy
All advertisements are pre-paid and strictly non-refundable. Because each listing activates customized placement and promotional infrastructure, refunds are impossible once payment is processed.
- 5.1 All transactions are final upon submission and activation.
- 5.2 No credit, exchange, or partial refund shall be granted for dissatisfaction, inactivity, or business closure.
- 5.3 Any attempt to reverse payment or file a chargeback constitutes breach of contract and fraud; the Provider reserves the right to recover all related costs, legal fees, and damages.
6. Content Responsibility
The Client is solely responsible for all text, graphics, images, business details, and claims contained in their listing. My Showroom does not verify factual accuracy or compliance with law. Material deemed unlawful, defamatory, obscene, misleading, harmful, or damaging to My Showroom’s reputation may be edited, suspended, or removed without refund. The Client indemnifies the Provider against any loss or claim arising from submitted material.
6.1 Platform Immunity & Safe-Harbour Protection
My Showroom operates as a neutral online platform. The Provider does not create, review, edit, endorse, or publish Client content. Listings are submitted independently by Clients.
To the fullest extent permitted under Australian law, the Provider is protected by all applicable online-platform “safe-harbour” principles, similar to those applied to YouTube, Facebook, Instagram, Gumtree, Reddit, and other user-generated-content services.
- The Provider is not liable for any illegal, false, misleading, defamatory, offensive, harmful, or infringing content uploaded by Clients.
- The Provider has no obligation to monitor content before publication.
- The Provider may act on content only when notified, or when legally required.
- All legal responsibility for uploaded content rests entirely with the Client — not the Provider.
This clause protects the Provider from liability in connection with Client uploads, conduct, representations, or misuse of the Platform.
6.2 Compliance With Australian Online Safety & Age-Verification Laws
My Showroom does not publish, host, or distribute any form of adult content, restricted 18+ material, or social-media-style user-generated content. The Platform operates exclusively as a commercial advertising service for Australian businesses.
Under the Online Safety Act 2021 and all subsequent amendments, including upcoming age-verification and access-control requirements, My Showroom is not classified as an adult-content service, social media service, or a platform requiring mandatory age-verification systems.
Notwithstanding this classification, the Provider maintains the following compliance position:
- 6.2.1 All listings submitted must be suitable for general audiences and must not contain age-restricted, explicit, harmful, or prohibited material.
- 6.2.2 The Provider may reject, suspend, or remove any listing that breaches the Online Safety Act, Australian Consumer Law, or any regulatory standard.
- 6.2.3 The Provider reserves the right to implement additional access-control or content-moderation measures at any time should Australian law expand its requirements to include commercial advertising platforms.
- 6.2.4 The Provider will comply with any lawful directive issued by the eSafety Commissioner, ACMA, or any authorised regulatory body.
- 6.2.5 The Client is solely responsible for ensuring their submitted material complies with all Australian regulations, including restrictions relating to alcohol, gambling, tobacco, adult services, therapeutic goods, or any category requiring proof of age.
This clause ensures ongoing legal compliance with evolving Australian age-assurance, safety, and content-regulation frameworks while confirming that My Showroom’s business model does not fall within the categories requiring mandatory age-verification systems.
7. Privacy & Data Protection
My Showroom collects only minimal operational data (contact, billing, listing content). Financial transactions are processed via secure third-party gateways; My Showroom never stores payment credentials or sells personal information. All correspondence is logged solely for fraud prevention and service verification. Requests for data deletion will be honored where lawful but will void all active advertising rights.
8. Platform Availability
The Provider strives for consistent uptime but does not guarantee uninterrupted operation. Maintenance, cyber-attacks, or external outages do not constitute breach or grounds for compensation.
9. Limitation of Liability
To the fullest extent permitted by law, the Provider shall not be liable for any indirect, incidental, special, or consequential damages (including loss of profit, goodwill, or data). Total liability shall never exceed the amount paid for the listing in question.
10. Indemnity
The Client agrees to indemnify and hold harmless the Provider and its affiliates against any claim, action, or expense (including legal fees) arising from Client content, misuse of the Platform, or breach of these Terms.
11. Termination
The Provider may suspend or terminate listings at its discretion for breach, misuse, or legal exposure. Termination ends all Client rights to use My Showroom materials but does not relieve payment obligations.
12. Governing Law & Jurisdiction
These Terms are governed by the laws of New South Wales, Australia. The Client irrevocably submits to the exclusive jurisdiction of its courts. The Provider may enforce judgments or seek injunctions in other jurisdictions as needed to protect its rights.
13. Amendments
My Showroom reserves the full right to modify, update, or replace any portion of these Terms, including the No-Refund Policy and Privacy Policy, at its sole discretion and without notice. Continued use of My Showroom following any changes constitutes binding acceptance.
14. Integrated Privacy Policy
My Showroom respects privacy and complies with applicable Australian Privacy Principles (APPs). By engaging our Services, Clients consent to the collection and limited use of information as described below:
- Data Collected — Business contact details, listing content, and transaction metadata required to operate advertisements and communication.
- Use of Data — Used exclusively for account administration, billing, and performance verification. No information is sold or rented to third parties.
- Storage & Security — All data is stored on secure Australian-based servers with encryption and access controls.
- Third-Party Processing — Payments are handled through independent secure gateways. My Showroom does not retain card details.
- Disclosure — Information may be disclosed when legally required or to prevent fraud, abuse, or illegal activity.
- Access & Deletion — Clients may request deletion of their data; doing so terminates all advertising rights.
- Cookies — Basic session cookies may be used to enhance navigation; these contain no personal identifiers.
